All sales are final, No Refunds: Please thoroughly review your invoice prior to making payment. We will build and deliver only what we have listed on the invoice. Please ensure color schemes, themes, product types, and quantities are correct. We will deliver to the location listed on the invoice, at the date/time specified. Please ensure that this information is correct. If we are provided with inaccurate information we cannot be held responsible or liable in any way.
Minimum Order: All deliveries require a minimum order of $100 worth of products, not including setup/delivery, discounts, taxes, and fees. Pickup orders are available on request, note that not all products will fit into a standard vehicle. Special promotional discount orders require $100 worth of products after promo code is applied.
Balloons will pop: We promise that all arrangements will be built to professional industry standards. Please bear in mind that although we use the highest quality materials and processes, we cannot guarantee how long these products will retain their shape, color, form, etc. after installation. Balloons can be affected by sunlight, temperature, wind, rain, sharp objects, vampires, static electricity, unruly children, office pranksters, etc. These effects are magnified outdoors but are also present for indoors.
Repairs/Changes: Thank you for understanding that once we have installed the decor we cannot return to fix, replace, or adjust the arrangements. We will work with you to ensure all items are placed according to your preference with regards to location, spacing, style, etc. However, once our team has professionally installed the decor and left the premises the job is considered complete.
Equipment: Items such as column/arch stands, bases, weights, floral decor, lighting, etc. which are used in the creation and installation of your decor are expected to be returned in most cases. If applicable we will make arrangements to come "strike" the job in order to beak down the balloons and retrieve those items. You will see this reflected on your invoice on the Set-up & Strike line item with Strike date/time specified. Any unreturned items will be billed at full replacement rate to include tax and shipping costs.
Payment Terms: Most invoices are billed on a pre-paid basis. Some larger corporate clients may be billed on terms, as stated on the invoice. All pre-pay jobs are due in full 2 weeks prior to event. This allows time for purchase of materials and scheduling of our team for building, installation, and breakdown. If you do not pay the invoice prior to the event we cannot build and deliver the ordered items.
Deposits: Entertainment jobs (face painting and/or balloon twisting) require a $50 non-refundable deposit per entertainer to hold the date, with the balance being due 2 weeks prior to the event.
Designs May Vary: Every order is custom and built to order, and every piece we create is considered a work of art. Although we hold our artists to the highest standards in striving for artistic excellence and accuracy, we cannot guarantee that any two items will look precisely alike or that they will exactly match a given example. We will make every attempt to obtain and utilize the specific colors and materials you have envisioned, however issues such as item shortages, shipping embargoes, and short lead time may affect this. We reserve the right to make artistic changes or use alternative materials as deemed necessary.
Installation Adjustments due to Safety Concerns: In rare cases installation of the products ordered may not be viable in the way they were originally intended. Examples of this are severe wind overpowering an outdoor arch, so that even with safety lines and weights it becomes a hazard to leave the arch installed. In such cases we reserve the right to make adjustments to the product design, installation method, location, etc. This may look like breaking an arch down and converting it to columns, or requiring that it be installed indoors. Another example is if there is no safe anchor point to tie a hanging design off to without damaging the walls of a venue, then the location of a balloon piece may need to be adjusted. For high elevation installations, there may be situations that we deem too dangerous to attempt, such as rigging a line to rafters if a proper lift and safety equipment isn't supplied. Although we will make every reasonable attempt at completing your installation as planned, please understand that the safety of our team is paramount and will not take unnecessary risks, nor will we leave any items installed in such a way that would present a potential safety hazard to our clients, or the general public. In such rare instances please be flexible, with the understanding that we will make the best attempt to complete the installation as close to originally planned as possible, however, there will be no refunds given.
Install Times: We provide a window of time in which to START the install. We cannot guarantee how long any particular install will take, as there are too many variables in locations, anchoring points to tie balloons off to, site access, weather, arrangement requirements, etc. We typically recommend to plan the install start time at least 2 hours prior to the event for most jobs, more for larger orders.
Cancellation Policy: Cancellation 5 days or more in advance will receive a full refund, less a $50 booking fee for holding the date. Cancellation 4 days or less will receive a 50% refund, as long as the products have not yet been built. Cancellation within 2 days of an event will not be refunded. Cancellation after products have been built will not be eligible for refund. Any CC processing fees are non-refundable. Any materials that have been purchased specifically to fulfil your order are non-refundable.
Reschedule Policy: Incurs a $50 booking fee. Two week max for date change. If the products are already built you will be given the option of having us deliver on schedule (this can be up to 5 days in advance of the event depending on the products). Any products that are already built will be billed for. Please give us as much heads up as possible so we can plan our building and delivery team schedules accordingly. Multiple date reschedules will incur a $50 booking fee each time the date changes, in addition to the aforementioned fees. Date change requests made within 2 days of an event will be considered a cancellation. We cannot guarantee we will be available and able to delivery products or entertainment services on any days other than the originally agreed upon date. If we are unavailable for the requested reschedule date, the job will be considered and treated as cancelled.
Waiver of Liability: By booking And Why Not Balloons, LLC (or it's DBA, Bruce Unlimited Designs) either by verbal or digital communication you agree to release, indemnify and hold harmless And Why Not Balloons, LLC or Bruce Unlimited Designs or it's shareholders, employees, sub-contractors against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by you or anyone on your behalf, including attorney's fees and related costs. If litigation arises pursuant to any claims made by you or by anyone else acting on your behalf, if And Why Not Balloons, LLC or Bruce Unlimited Designs incurs any of these types of expenses, you agree to reimburse And Why Not Balloons, LLC.
